FISCAL INCENTIVE FOR INNOVATION
Companies in the distribution, transmission and generation of energy sector must annually apply a minimum percentage of their net operating revenue in the Energy Sector Research and Development Program. The application of these resources is provided for in Law and in the concession contracts being established by ANEEL the guidelines and guidelines that regulate the development of R & D projects. This continued development places the industry among the top R & D investors. In this way, the mapping of the innovative activities can correctly obtain a high potential of recovery of the values ??invested in the development activities and that also include the researches on the processes to increase the efficiency of the production and distribution of energy, as well as for the conservation of energy. With the Good Law, up to 27.2% of the expenditures employed in these projects can be returned to the company’s cashier.
The complex tax and regulatory legislation for the Brazilian electric sector also stems from its varied activities such as: generation, distribution and commercialization being governed by various laws, decrees, resolutions, and ordinances of the regulatory agency (ANEEL), as well as MME Normative Acts. The intensity of the changes requires the monitoring and periodic review of the legislative impacts on the sector with highly taxed activities due to the essentiality of the product and the ease of collection and inspection.
